Mrs. Green's Polls West Village on How Tolerable They'd be Through a Labor Battle

Naturally unfair to workers. That’s been the tagline for Mrs. Green’s Natural Market since being found guilty of violating their workers rights and illegally firing eight of them for wanting to join a union. The federal charges, terrible press and community outrage hasn’t taught Mrs. Green’s a lesson apparently; numerous residents have notified us that the company’s newest store in New York City has been polling the community on their view of unions, and workers.

The New York Post reported on the odd surveying earlier this month: Just a few weeks after opening a new outpost in the West Village, the upscale, organic grocer has managed to put off its left-leaning customer base while giving union organizers added ammunition. The grocer, in an apparent effort to gauge residents’ attitudes toward unions, asked whether it was “important” to shop at stores that employ union members, said a resident who participated in a phone survey Mrs. Green’s conducted a month ago. - http://nypost.com/2015/11/08/labor-pains-for-nycs-new-mrs-greens-store/

Residents have also complained about Mrs. Green's garbage on sidewalks
West Village residents saw right through the survey and became aggravated enough to mention it to our Organizing team while walking by the picket line at the store. Among many complaints, a tipster sent our organizers this note: " I just took a long and exhaustive phone survey that was clearly paid for by Mrs. Greens and wanted to gauge their customer’s views on unions and how important a unionized workforce is. I let them know that if I was given a choice, I would always chose a unionized shop. There was a section that tried to do a bit of "push pulling" where they had me respond to every phony argument that management gives for not supporting unions. eg. "employees should be able to speak directly to management" or "union dues will lower employee's take home pay" I said that I disagreed strongly with all the excuses. I thought that you'd like to know."

With 18 stores, mostly in the tri-state area, and aspirations to open more, Mrs. Green’s has been feeling the pressure from our union, enough so to pay for a community poll on opinions of unions.

The real question is, why would a company found guilty of firing workers because they wanted a union, ask a community what they think about unions? Mrs. Green’s to Suddenly Close Hartsdale Store

Mrs. Green’s Natural Market announced it would be closing its 20,000 square-foot Hartsdale store on Central Avenue on November 12, 2015. The store opened its doors there only two years ago, on November 22, 2013 According to the Edgemont Community Council, Mrs. Green’s sent an announcement of its Hartsdale store closing this morning to all customers on its email list.

The announcement stated that it will work “very hard” to find new jobs for its employees and would “continue to service the customers of central Westchester County in many of our other locations like Rye, Tarrytown and Eastchester.” No reason was given for the store’s abrupt closing, but there have been reports of legal troubles stemming from its bills not being paid and customers who shop at Mrs. Green’s in Hartsdale have reported seeing very few people there. Best Yet purchased the lease and re-opened the store a week after its closure.

“We immediately began receiving calls from Hartsdale workers who were in a frantic,” said Director of Organizing Aly Waddy, “These hard working men and women had no one to turn to. The company gave them no answers, and they got no information and a short notice they would be losing their job,” Waddy explained. Waddy also indicated that the workers said they rumor was they would receive “some type of severance package” but no specifics were available. A former worker of the Hartsdale store who wished to remain anonymous in fear of retaliation explained the process:
I was an employee for Mrs. Green’s in Hartsdale when they decided to close it. Most employees found out that the store was closing through an email that was sent out to the customers that everything was 50% off. The HR woman was very aggressive and I mentioned it to her, she doesn't seem like she cares, all she really cared for is that we sign severance papers. I don't know what to do for my coworkers they offered me a position after they told them there are no open positions they screwed us over and the severance package contains a lot of "fishy" stuff…a lot of clauses”
“The workers throughout the entire chain saw us fight back against the company’s irresponsible practices and work alongside community members in Mount Kisco to get eight illegally fired workers re-hired. They trust that we’re there for them, more than their irresponsible employer. Some workers from the Hartsdale are being transferred to the Mount Kisco location. There is still confusion on how that is being done, it doesn’t seem to be organized, seems almost it’s a favoritism system. Workers with good records and seniority are still being displaced. We are investigating to see if Union supporters were selectively displaced,” Waddy explained.

Working for Workers: NYC Politicians Send a Message to Mrs. Green's Natural Market

Last month, NYC politicians sent a letter to Mrs. Green's Natural Market expressing their concern for their labor practices.  The company was federally charged earlier this year for unlawfully firing 8 workers who supported United Food and Commercial Workers Local 1500.  The workers had no prior records and were combined working at the company for over 50 years.  Workers were on a picket line for over 6 months until the company folded to public pressure settling the charges and rehiring workers with back pay.

Although the company tried to "spin" the story and say they welcomed the workers back, if it wasn't for the tremendous community support, along with NLRB charges, workers would still be out on the picket line.

Mrs. Green's planned on opening a store in New York's West Village this Spring 2014, but there have been numerous delays.  The store is still not open (September 2014) and New York's West Village politicians want to ensure their new neighbor won't be restricting the rights of their workers like they have in their other stores.   Thanks to NY Senator Brad Hoylman, Assembly Member Deborah Glick and Council Member Corey Johnson,  for sending a letter to the Senior Vice President and Chief Human Resources Office of Mrs. Green’s Natural Market and standing up for retail workers.

Mrs. Green's CEO Robin Michel Steps Down

UFCW Local 1500 Official Local, 2013

Statement from New York's Largest Grocery Workers Union on Mrs. Green's Natural Market CEO Removal

United Food and Commercial Workers (UFCW) Local 1500 President Bruce W. Both released the following statement on the removal of Mrs. Green's Natural Market CEO, Robin Michel:

"The news of Mrs. Green's CEO Robin Michel's removal is welcoming to the fired workers who have been picketing in front of Mrs. Green's in Mt. Kisco since January. Through Robin Michel's leadership, Mrs. Green's Natural Market has transformed from what was once a friendly neighborhood natural foods store, to a company that emulates Walmart's labor practices, putting a strict priority on expansion and profits, over people."

"Mrs. Green's unacceptable anti worker behavior began with Ms. Michel's tenure and was exemplified by its vicious anti-union campaign the company launched in April 2013 that instilled fear in the workers and contributed to our union's narrow election defeat. It culminated with the unlawful termination in January of eight workers for standing up for their basic rights at work.

"Workers like David Ramirez, who had become a cornerstone in the store throughout his nearly 10 years of employment, were left out in the cold during a frigid winter on a picket line, simply for standing up for his rights at work. Community, labor and faith leaders will continue to stand with the fired workers until Mrs. Green's ends its labor dispute."

Mt. Kisco Natural Market Fires Nine Employees After Meeting With Elected Officials on Union Campaign

"Mrs. Green's Natural Market Fires 9 Longtime Employees for Supporting Union"- Labor Union

Union says 9 longtime employees were abruptly fired after supporting union and meeting with local politicians on improving working conditions

After standing up for their basic civil rights and speaking to local elected officials about solving problems at their job, nine workers from Mrs. Green's Natural Market in Mt. Kisco, NY were abruptly fired last week. The United Food and Commercial Workers (UFCW) Local 1500 called the firings '"retaliation" for standing up for "basic, protected, civil rights" and "supporting the union".

All of nine fired employees supported the union in a highly contested union election in May 2013. After employees filed charges that Mrs. Green's was violating their civil rights, the Federal Government charged Mrs. Green’s with violating labor laws.  Subsequently, Mrs. Green's committed in writing, to the National Labor Relations Board that it would respect its employees' rights to join and support a union, and refrain from retaliation. It posted a federally-issued notice in the Mt. Kisco store, informing employees of their basic rights at work, including the right to organize a union.

Reneging on its promise to the workers and the government, it has fired nine long-term employees, eight of whom have been with the company for over seven years and the least senior for over three years.

"They told me I was fired for poor customer service and that sales were low," said David Ramirez, an eight year employee who was fired last week. "It came as a shock to me and all of us, we were all told the same reasons for being fired. It's not a coincidence that all of us supported the union. I just stood up for what I believe in," said Ramirez.

The union has filed federal charges against the company on behalf of the fired employees and is planning a comprehensive public outreach campaign with Mt. Kisco community members. "Not only are the firings a retaliation, but Mrs. Green's has demonstrated a clear disrespect for labor law, and basic civil rights of their employees," said Secretary-Treasurer Tony Speelman, "These brave employees were not just on the job for a few days, some of them have over 10 years experience at Mrs. Green's. It disgusts me a company would sink this low to prevent workers from banding together to improve their workplace."

"It is a fundamental right of all Americans to participate in a union election without facing intimidation, interrogations, threats that their store will close and they will lose their jobs. Mrs. Green's management did every thing in their power to deny these workers their rights under law," Union Organizing Director Aly Waddy said, "Now, with these unjust firings, Mrs. Green's is following through with their threats, they've fired employees who have stood up for their fundamental rights as Americans, and intimidated even more workers."

"Mrs. Green's pledges a commitment to good food and good health for their customers but as soon as we united to demand good jobs, Mrs. Green's true colors came out," said Marta Urgiles, an employee of over 10 years who was fired last week, "We've supported the company and community of Mt. Kisco for years, for it to end like this, right after the holidays, is despicable" said Urgiles.

Community members throughout Mt. Kisco were outraged to hear the news of the firings and have reached out to the fired workers to pledge their support.
