UFCW News: Organizations Urge Supreme Court to Uphold Civil Rights and Workers' Laws in Amicus Brief Filed Today...

MAJOR WORKER ORGANIZATIONS URGE SUPREME COURT TO UPHOLD CIVIL RIGHTS AND WORKERS’ LAWS IN AMICUS BRIEF FILED TODAY

(Washington, DC) –The United Food and Commercial Workers International Union (UFCW), AFL-CIO, and Change to Win have filed a joint amicus brief to the U.S. Supreme Court supporting the plaintiffs in the Dukes v. Wal-Mart Stores, Inc., sex discrimination case.

A joint statement follows:

“For more than 45 years, American workers have sought protection from the courts for equal treatment in the workplace. Workers have joined together to remedy widespread discriminatory workplace practices through class action proceedings and by applying the nation’s civil rights standards to their workplaces. Today, Walmart is attempting to undo that standard by claiming its female associates have no right to appeal for justice as a class.

In our amicus brief to the U.S. Supreme Court, we ask the court to uphold the fundamental pillar of the Civil Rights Act and to ensure that the class action process remains open to workers in all industries.

Walmart is not too big for justice. No employer should be beyond justice for its workers. Workers must have a voice in the legal process. The cost to Walmart if it loses the suit would be a fair recompensation for billions of dollars in lost wages and benefits owed to female employees who have lost opportunities as a result of Walmart’s discriminatory actions.

With more than 1.4 million associates nationwide, Walmart has single-handedly transformed the American economy by setting workplace standards by which all other retailers and employers are forced to compete. Because Walmart’s employment practices are so influential, its female associates must be allowed to have their day in court. We congratulate the brave women who initiated this complaint and who seek to create a Walmart workplace that treats all associates equally.”

MAKING CHANGE AT WALMART STANDS IN SUPPORT OF LOCAL VOICES

Community coalitions across the country push for quality job creation,
challenge Walmart on new stores in major U.S. cities

WASHINGTON – Coalitions in cities targeted for new or expanded Walmart stores took action yesterday to rally for sustainable, quality job creation in their communities. Across the country, community members, elected officials, religious leaders, chambers of commerce, small business owners and others joined together and spoke out to ensure the jobs being offered by Walmart meet strong standards for healthy, growing communities. These coalitions plan to engage local policymakers about the need for quality jobs and responsible business practices as the real path to economic recovery.

Events and announcements happened in Boston, Chicago, Los Angeles, San Francisco, and Oakland. Planned events in New York City; Philadelphia and Washington, D.C. were rescheduled due to snow. The following Locals are active in these cities’ coalitions: 5, 8GS, 338*, 400, 770, 881, 888, 1102*, 1167, 1428, 1445, 1500, and 1776. Regions 1 and 8 and the RWDSU District Council of the UFCW are playing major coordinating roles in this effort. "As a grocery store employee and Chicago native, I think we must create jobs that pay fairly and raise standards for the entire industry," said J. Marie Hopkins, a UFCW member for 36 years, cashier at Jewel Food Stores in Chicago, and resident of the 21st Ward. "That's why my fellow union members in the UFCW are standing with these community coalitions. We demand a say about the kind of businesses that come into our neighborhoods."

Hopkins is one of the many UFCW members around the country who is committed to supporting Walmart Associates in their work to get the respect from the company that they deserve. Two Walmart Associates from the Baldwin Park, California store spoke at yesterday’s event in Los Angeles.

In cities across the United States, Walmart is seeking access to new markets and customers, spurring local and national debate for good reason. These local coalitions have formed to educate the public and policymakers about the impact of Walmart’s business practices, and call for quality jobs that allow people to sustain their families. Walmart has been documented for its controversial and sometimes illegal employment practices, poverty-level wages and for ranking highest for the number of employees qualifying for state government health care assistance.

Making Change at Walmart, a campaign of the United Food and Commercial Workers International Union, stands in solidarity with these community coalitions in major cities across the country as they push for higher standards for working people and question Walmart’s entry or further expansion into their cities. WakeUpWalmart.com Launches “Hope for the Holidays” Campaign to Highlight Walmart’s Track Record of Poor Product Safety


(Washington, DC) - The 490,000 members of WakeUpWalmart.com today launched a consumer education campaign to highlight Walmart’s track record of stocking dangerous and unsafe products. Activists and community leaders from across the country will come together to inform consumers about Walmart’s business model and how it encourages the production of dangerous products and puts profits above the safety of consumers. Supporters of WakeUpWalmart.com and the National Consumers League will also send Walmart CEO Mike Duke an open letter asking him to put consumer safety ahead of profit this holiday season.
Walmart has repeatedly carried products that have been identified as unsafe or dangerous by reputable consumer safety organizations. Right now, there are children’s holiday gifts offered for sale at stores and online with high levels of dangerous substances including lead, chlorine, arsenic, cadmium, and bromine according to HealthyStuff.org, a project of the Ecology Center and the Center for Environmental Health.


WakeUpWalmart.com and the National Consumers League are calling on Walmart to pull these dangerous products. These products include:

 “As the world’s largest retailer, Walmart should be a leader in improving safety standards for the products it carries,” said Pat O’Neill, Executive Vice President of the United Food and Commercial Workers International Union. “Unfortunately, right now Walmart is using its size to push suppliers to produce at a lower cost which could end up compromising product safety. Saving money and living better should not mean pushing suppliers to cut costs that may result in cutting corners. Our wish list for Walmart is that they ensure their products are safe, so families don’t have to worry. Walmart can certainly afford to take extra precautions to inform customers of potential safety concerns.”


In addition to educating consumers about Walmart’s unsafe business practices and dangerous products, WakeUpWalmart.com, the National Consumers League, and their supporters will sign an open letter to Mike Duke demanding that Walmart take responsibility for the products on its shelves. In it, consumers tell Duke that, “We know Walmart can afford to do right by America’s families and help make this holiday a safe one. As the nation’s largest retailer, Walmart has an obligation to pull products with toxic levels of chemicals from its shelves—and end the unsafe practice of pushing suppliers into cutting corners.”
