Morning Read: I've got 99 Walmart Problems

600 people rallied in Chicago supporting Walmart warehouse workers who are calling for change.  What does Walmart do? Hires private security in riot gear to confront their workers' on the job safety issues, sexual discrimination issues, pay....then has 17 employees arrested for peaceful protesting.

Elsewhere, while the Presidential Debate will leave Colorado tonight, the Walmart debate on whether the small business killing retailer should build a new store near the university rages on.

More Walmart Problems: Walmart is welcomed in Fall River, but local unions are upset they're building it non-union.

Walmart women in Tennessee are paid less than men (of course they are), they filed suit against the company.

The UFCW International brought former Walmart workers to Wall Street to speak to analysts about company problems, safety issues.

As we mentioned last year, Aldi inked a lease to open their first store in Manhattan- This week they opened the doors in Harlem.  30 jobs are estimated to be created.  More @ Supermarket News.

What We're Reading Tuesday Morning: Amish Market gets Busted...Again

Target's PFresh remodels (yeah the one that closed the Valley Stream store for 7-months) are popping up all over the country, but no others are closing for that extended period of time, weird.  Here's a complete list of all their scheduled re modelings.

A few years ago UFCW Local 1500 was contacted by workers at Amish Market, we eventually helped win nearly $1.5 million in back-pay & unpaid overtime wages for a handful of workers at the chain of stores.  We knew these employers took advantage of their workers, but this week federal authorities charged the nine owners  w/ conspiring to hide $56 million in sales from the IRS.  Stealing wages from low-paid workers, hiding millions from the IRS, way to go guys!  More @ Supermarket News.

16 miles from NYC, Walmart eyes it's first Neighborhood Market in Jersey.

And their express city format store has failed. Walmart plans to close their Chicago Express store, one year to the day that it opened.  Talk about #WMTFail, they said they couldn't survive with a Supercenter nearby.  More @ Chicago Tribune.

Shake Your Head Story: Despite earning a record $4.9 billion profit last year, and projecting a better 2012, manufacturing giant Caterpillar is pushing a six-year pay freeze on workers and a pension freeze for most of the 780 production workers.  But miraculously they did find a way to raise executive compensation including giving CEO $17 million.  Check more @thinkProgress.

What to Read Wednesday: How much will the bribes hurt Walmart?

Progressive Grocer writes about Target remodeling stores, neglects to write how stores throughout the country will remain open, but Target Valley Stream will close in 4 days for renovations.


Walmart, after bribing Mexican Officials to get into Mexico, is working here in the U.S. to weaken International Anti-Bribery laws.  Forbes looks at what this will mean for their business, TheStreet wonders if they're the next Enron and if AG Eric Holder will go after Walmart.

The Mexico news has stirred up lots of politics in NY races.  The USA Today covered yesterday's Walmart speak out at NYC City Hall.

Governor Cuomo (N.Y.) doesn't have a position on Walmart in NYC.

To respond Walmart has created a new position to insure the company is in line with the US Foreign Corrupt Practices Act.

Whole Foods will be opening a 'pop-up' store in Montauk for the summer season. The farmers market type store test the location to see if they'll be able to set up permanently in the East End of Long Island.

Walmart's N.Y. Lobbying Increased 2375% in 2011...Yeah, You Read that Right

So how bad does Walmart want to be in NYC? 2375% more than they did in 2010.  NYPIRG announced New York's 2011 record-breaking lobbying totals, revealing the world's largest employer, Walmart, spent $2.8 million lobbying in 2011 an increase from $113,432 in 2010.


Pretty nice that Walmart can increase spending like this with a snap of the finger.  Just goes to show you they've got no problem spending money wooing New York's politicians, just a problem spending money in order to make their jobs, good jobs for our communities.  Check out more from the Times Union and check out Making Change at Walmart.

Monday Mornin' One-Liners: #OWS & Labor, Walmart's Health Plan Gets Worse

Good Monday Morning! Below are relevant NY grocery industry news stories for today:

Stop & Shop signs a lease for a new store in Purchase, NY.

Ben & Jerry's newest ice cream, Schweddy Balls, has been banned by Stop & Shop.

In Europe, rumors of Aldi's plans to sell beer for a buck in 2012 have people angry.

The highly criticized Walmart health plan is changing, for the worse: Wal-Mart is substantially rolling back coverage for part-time workers and significantly raising premiums for many full-time staff.  This is due to "rising costs", meanwhile the five Walton heirs who are listed in the Forbes 400 Billionaires list are worth a total of $86.4 billion.

New York City Council Speaker Christine Quinn slammed Walmart on Friday after learning of the Health Care cuts.


UFCW International President Joe Hansen released a statement on Walmart's Health plan changes, saying, "This lowering of working standards will have repercussions throughout the retail industry- particularly for part-time workers."


UFCW International also endorsed Barack Obama last week.

A&P has been fighting to save a development in New Jersey, where the landlord was accused of soliciting other retailers & having reservations about the bankrupt company...Last week a judge adjourned the dispute, encouraging A&P and the landlord to settle out of court.  Another hearing has been scheduled for Nov. 14.

Local 1500 raised over $9,000 for the Making Strides against Breast Cancer walk at Jones Beach.  Local 1500 member Jessica Goldstein was quoted, “We walk every year to show support from the union we work for,” in the Long Island report.

UFCW International President Challenges White House: Tell Walmart to Create Good Jobs & End the Poverty Cycle

WASHINGTON, D.C. – The following statement was issued today by Joe Hansen, International President of the United Food and Commercial Workers Union (UFCW), in advance of an event in the White House in which First Lady Michelle Obama recognizes retailers who are willing to expand their business into under served areas. Walmart is among the attendees.

 “The First Lady’s commitment to addressing childhood obesity in the U.S. is laudable and the UFCW commends her for her enthusiasm for such a worthy endeavor. But with income disparity between the rich and the poor at more extreme levels than during the Great Depression, Walmart must be held accountable for its track record of lower standards for millions of retail workers.

“Walmart is more responsible than any other private employer in our country for creating poverty-level jobs that leave workers unable to purchase healthy food or provide a good life for their families.

 “I met Walmart Associate Girshreila Green last month who told me that she got her job at the inner-city Crenshaw Walmart in Los Angeles through the welfare-to-work program. And after three years of work and an excellent employment record at what she calls the ‘ghetto Walmart,’ Girshreila still has a welfare card in her pocket, right along with her Walmart I.D. and Walmart discount card.

 “There is no economic justification that our nation’s largest private employer should pay wages so low that any of its employees qualify for public assistance. But the fact that tens of thousands of Walmart associates qualify and utilize food stamps, Medicare, and Medicaid is reason enough that the White House should join with our union and tell Walmart – enough is enough.

 “Our national economic crisis is made worse by companies like Walmart suppressing wages for its 1.4 million hourly workers who live and work in communities across the country.

“Walmart claims it wants to open stores in urban markets like Washington, D.C., Chicago, New York, Los Angeles and other major cities. Workers, community leaders and consumers in each of those cities have called on Walmart to commit to providing good jobs that pay wages high enough to improve the lives of workers in those cities. The fact is, when Walmart opens in a community, it replaces what were good jobs with poverty-level ones. Walmart continues to drive the cycle of poverty by lowering wage rates and preventing associates from lifting themselves out of economic insecurity.

 “Millions of grocery workers serve communities of every income level and hold good jobs with fair wages, affordable health care, and a voice on the job. The White House should laud employers who are fueling economic recovery by creating good jobs where workers can afford to take care of their families and buy the healthy food their children deserve.”

Tuesday Morning News Briefs: 4/16-4/19

In Greenburgh, the town is offering free shuttles to ShopRite once a week, in order to deal with the town's two A&P supermarket closures.

Developer seeks money back from A&P...

A&P has listed the 25 SuperFresh stores for sale.

The Equal Employment Opportunity Commission here said Wal-Mart has agreed to pay $440,000 to settle a federal harassment lawsuit by 10 employees who said they endured ethnic slurs and derogatory remarks on a daily basis while working at a Sam's Club in Fresno, Calif.

Here's a shocker to some, Target beats Whole Foods in sustainably seafood rankings.

In Massachusetts where a controversial Whole Foods is being planned in a low income area, it was recently discovered a task force official sitting on the Town's Board of Directors is actually employed by Whole Foods.  Whole Foods has also made donations to the town board.  The Wall Street Journal has more on the fight.

A&P has said it has approached bankruptcy courts to approve the sale of 25 Superfresh stores, as part of its plans to revive its business. The firm said the sale includes 22 outlets in Maryland, two in Delaware and one in Washington D.C. [Press Release]

So A&P is trying to sell 25 Superfresh stores as part as their turnaround strategy, why Superfresh? The Baltimore Sun analyzes the situation.

And then there is a planned Pathmark to open in North Liberties, PA. Where the developer has petitioned the bankruptcy judge to 'clear the way for a new supermarket to open', where Pathmark has continued to stall and are according to the motion "affecting the ability to sign leases with other tenants in the shopping center."  Read it @ Philly.com.

Seems that everyone is getting their licks in on A&P, in NYC a developer is suing A&P to recover some $6 million they put down on a deal which fell through to develop two luxury towers on Cherry Street in Manhattan. Read it @ WSJ Blogs.

If you've been following the Walmart South Africa story, Walmart's merger w/ Massmart (South Africa) is a threat, both sides have been unwilling to unwillingness to make any  commitments that would address public interest concerns about the impact of the merger on local procurement, food security and broad-based black economic empowerment: “A merger of the size of the proposed Wal-Mart/Massmart transaction, and with the size and leverage of the parties which are involved, could, if not properly regulated, go some way towards undermining the New Growth Path”, the departments said.

In Ohio, Nina Turner, a Senate Democrat, said, “This bill seeks to vilify our public employees and turn what used to be the virtue of public service into a crime.” At its heart, the bill redraws rules governing how several hundred thousand public-sector workers bargain with the governments that employ them. Among the most objectionable parts, workers said, are the rules giving local officials the final say in breaking labor impasses. Currently, non-elected, third parties decide.
Why are workers being used as bailouts for economic problems? The elected officials are mostly to blame for fiscal problems, not workers!

Yesterday, the New York City Council held a hearing on Walmart's labor history.  The hearing was filled with testimonies from Women's Advocacy groups, former Walmart employees, Unions, Attorneys, Gay Advocacy groups, Researchers & community groups.  Though Walmart was extended an invitation, they did not attend, again.

Consumerist: Walmart says returning books and magazines is illegal?

Aldi (under the Trader Joe's corporate umbrella) had their grand opening in NYC (Queens) today. They have huge expectations for NYC. [Press Release]  They've also said, they're not done opening stores in NYC.   
via Crain's: In the Bronx, Aldi signed a lease at 1750 E. Gun Hill Rd. near the Westchester County line in a nearly vacant shopping center. The 18,000-square-foot store is expected to open late this year, though construction has not begun yet.
In Bayshore, Aldi has a space at 1851 Sunrise Highway. The Rego Park store is located at 61-11 Junction Boulevard.
It's great to see affordable supermarkets opening, though, Aldi stores don't generate many jobs for communities, and the jobs that they do provide aren't union.   We see Target opening smaller stores in Chicago and Walmart focusing on smaller store formats, these stores are looking to eliminate jobs and replace them with more demanding working conditions for less pay.  Not only do we need healthy and affordable food options, but we need jobs that provide paths for career development, health care and provide solid, sound means to supporting families. Enjoy your weekend and as former Walmart worker Kenneth James said to me yesterday after his testimony, "Keep fighting the good fight."  


Recap of the NYC Council Hearing: When Walmart Comes to Town

Wal-Mart is the largest private in employer in the country; it also has the largest class action law suit against them for discriminating against female employees. In addition to this it is recognized by Human Rights Watch as the greatest violator of worker rights. So it is no surprise that Wal-Mart was a no show at New York City Council hearing yesterday to discuss Wal-Mart’s labor practices and documented history of discrimination against women.
Before the hearing there was a demonstration in front of the Emigrant Savings Bank where the hearing was held. Protesters held up signs that said “Wal-Mart is Anti Women” and “Wal-Mart sucks the life out of Communities”. They also chanted “Wal-Mart cheats, Wal-Mart hates, Wal-Mart discriminates”. Joining protesters were former Wal-Mart employees from around the country, who testified on their experiences working for Wal-Mart.

During the hearing several panels gave testimony on facts about Wal-Mart’s practices in discriminating against women and violating workers rights. Annette Bernhardt, Policy Co-Director at National Employment Law Project testified that Wal-Mart participates in a practiced called “time-shaving” where if any employee is over 40 Hours they will go into the system and remove the overtime hours to avoid having to pay the employees’ overtime.
Kenneth James a former Wal-Mart department manager testified how after he participated in a press conference to support the Employee Free Choice Act his hours were reduced from 37 hours a week to 18 hours a week; he went on to say that at one point he received a paycheck for $514, and was then forced to live off of $14 for two weeks after having to pay his rent. He also testified that female co-worker also suffered retaliation after participating in the press conference and her hours were reduced to zero.

Councilman Eric Ulrich commented that” We have the toughest laws, Wal-Mart won’t [participate in wage theft] do it here, and that with these economic times any job would be good.” To which Bernhardt responded that is doesn’t matter what laws are in existent if they cannot be enforced because of lack of resources and when the only solution are lawsuits. Councilwoman Melissa Mark Viverito also responded to Ulrich’s comments by saying that New Yorkers ‘don’t just want any jobs, they want good jobs that will help our communities and the people in them grow.’

It was clear throughout the hearing that Wal-Mart has systematic pattern of violating workers rights and discriminating against women: whether it be by cutting pro union workers hours or denying women promotions. Their promise of jobs and low prices isn’t enough for New Yorkers. Wal-Mart’ decision to not appear at the New York City Council hearings and defend its self shows its unwillingness to face the facts and own up to what they have done. It is also insulting to the NYC Council members and the New Yorkers that they represent. How can we allow them to enter our communities if they are not willing to answer our questions and face us?

Walmartnyc.com Promotes Report which Confirms a Walmart NYC Store would Lower Wages

Here's something you don't see everyday, Walmart is telling the truth.

The ingenious website www.walmartnyc.com which does a great job promoting real "New York" opinions, is promoting a report from ABC News which covered NYC Public Advocate's Bill de Blasio's report that if a Walmart were to open in NYC retail wages would suffer.  Here's a screen shot from WalmartNYC's newsroom:
